Registering for Foreigners
Foreigners are allowed to own 100% of a company registered in Malaysia. However in certain industries such as education, banking and finance, agriculture or tourism industries, companies face stricter rules and require local Malay co-ownership (at least 30% of the capital) and other requirements may apply. Two ways to register a foreign-owned company in Malaysia:
- Incorporate a local company with the Companies Commission of Malaysia (SSM)
- Register an existing foreign entity in Malaysia with SSM
Company Registration Process
1. Think of at least 3 business names
Come up with at least three business names. We recommend that you do not use any of your personal information in any one of them.
2. Do a name search
The first step to registering a new company in Malaysia is conducting a name search. Its purpose is to determine whether the proposed company name is available. So it’s important that you brainstorm your business names well.
3. Submission of registration documents
Registration documents must be prepared and submitted to SSM no later than one month after receiving the approval for the proposed company name. Failing to meet this requirement will bring you back to the previous step and conduct a new name search.
4. Receiving certificate of registration
A successful submission ends with receiving a certificate of registration issued by SSM. Your company is then ready to start in Malaysia!

- Copy of all directors’ & shareholders’ I/C or Passport
- Proof of residential address
- Certified copy of the certificate of registration or incorporation of the foreign company
- Certified copy of foreign company’s stature, charter and articles of association
